General Terms and Conditions

Article 1
The purpose of these general terms and conditions of the seasonal rental contract is to define the terms of the rental of the property by the owner to the tenant for the duration and under the conditions specified herein.

Article 2 – Duration of Stay
The tenant signing this contract, concluded for a specific period, may under no circumstances claim any right to remain in the property after the stay.

Article 3 – Reservations
The availability of the property will be confirmed by the owner. The number of people occupying the property, as well as their identities, must be specified when making the reservation (the use of the property will be limited to these people and must not exceed this number for insurance reasons).

Article 4 – Conclusion of the Contract
The reservation becomes effective once the adult tenant has paid the owner a 30% deposit of the total rental amount. The rental agreement between the parties cannot in any case benefit, even partially, any third party, whether a natural or legal person. Any breach of this provision may result in immediate cancellation of the rental at the tenant’s expense, with the rental payment remaining definitively acquired by the owner. The rental price is inclusive of all charges (water, electricity, heating, Wi-Fi, and linen). No disputes regarding the price of the stay will be considered after the contract is accepted.

Article 5 – Arrival / Departure
The tenant must arrive on the day and at the time specified in the booking confirmation. In case of late or delayed arrival, the tenant must inform the owner. The tenant must also vacate the property on the day and at the time mentioned in the booking confirmation.

Article 6 – Payment of the Balance
The balance of the rental amount is paid upon entry into the property by bank transfer to the name of the tenant who made the booking or in cash.

Article 7 – Inventory
The property is rented furnished and equipped as described. An inventory will be conducted jointly and signed by the tenant and the owner or their representative upon arrival. This inventory constitutes the sole reference in case of a dispute regarding the condition of the property. The cleanliness of the property upon the tenant’s arrival will be noted in the inventory. End-of-stay cleaning is provided by the owner.

Article 8 – Use of the Property
The tenant must ensure the peaceful enjoyment of the property and use it in accordance with its intended purpose. Children are under the sole responsibility of their parents or accompanying persons.

Article 9 – Capacity
The maximum capacity of the property must not be exceeded. If the number of tenants exceeds the property’s capacity, the owner may refuse the additional persons. Any modification or termination of the contract will be considered at the client’s initiative.

Article 10 – Pets
For hygiene reasons and to respect all guests, pets or other animals are not allowed in the property. If the tenant violates this clause, the owner may refuse the stay. In such a case, no refund will be provided.

Article 11 – Insurance
The tenant is responsible for any damage caused by their actions. The owner agrees to insure the property against rental risks. The tenant must report any incident within 24 hours of occurrence to the owner.

Article 12 – Smoking
Smoking is strictly prohibited inside the property (ashtrays are available outside).

Article 13 – Disputes
Any complaints regarding the rented property must be submitted within 48 hours of arrival by registered mail addressed to the owner, accompanied by supporting documents. Once this 48-hour period has passed, complaints will no longer be considered.
In case of dispute, the Commercial Court of Essaouira shall have exclusive jurisdiction.
